Well, there goes my vulcan. I got rear ended by a woman who wasnt paying attention. im fine, most of my injuries were from me falling over. but the bike is most likely totalled.

Glad to hear you only have minor injuries. Hope her insurance co. pays you a good price for the bike. Looks like we will have another parts bike on Ebay. Or are you thinking of trying to fix it after it is totaled by the insurance Co.?

Glad you came through with non-life threatening injuries. You can't avoid every idiot on the road, but keep an eye on the mirrors when you're stopped, especially until there are two or more cars stopped behind you. They make good shock absorbers for those preoccupied with their hand held electronic devices! Have an exit plan in mind when you need it.

my wife and I have been rear-ended 5 times in our cars. so far not on a bike.
one guy even had the nerve to tell the cop that took the report that it couldn't be his fault since my wife should have run the red light !

not normally my job to be a Pollyanna but look at it this way: there were no major injurys, she will pay more attention to bikes on the road( at least for a week or two), the taill of her increased insurance will warn her friends and you get to go toy shopping with her insurance money:pepper:

Obviously, by far the most important thing here is that you came out of this with only relatively minor injuries. Thank God!!!

Given the current motorcycle market and the length of time the VN750 was built, a replacement Vulcan 750 in really good condition shouldn't be too hard to come by--especially if you have true patience and are willing to shop around some.

I guess what you need to ask yourself is....what can I learn from this experience to make myself a better rider? What can I proactively do to help avoid this same (or similar) situation in the future?

About half the game of being a great street rider is getting nearby cagers to really notice you.

well the other person's insurance company is going to total the bike and pay me for it. its more than i paid for the bike a year ago. so woot. :D
i may have some goodies that i might sell.
thinking about getting a SV650 instead.

The inattention of cagers kills me, though (not literally so far, thank God). Like the woman that I narrowly avoided the other day who nearly merged into me while holding onto her stupid lap dog. And then she had the nerve to stare at me like I was somehow at fault for having the *nerve* to be where she wanted to drive her tank... :BLAM:

Again, glad you're OK, and I hope the ticket that she received was nice and heavy...

Achang, I'm glad you wren't injured. But I would not settle for anything the insurance company offers. I would demand some punitive damages from the lady who wasn't paying attention. What if you had a child or grandchild on the back of your bike? This woman is a danger to society and if she gets off without having to pay punitive damages she's only going to do it again to someone else. You owe it to your fellow man to punish her for her deadly driving habits. I'm serious my friend. If you found out she killed some kid by plowing into a family's car that was stopped at a stop light, you would feel terrible that you didn't try to stop this woman. Why wasn't she paying attention? Was she on a cell phone or something? She has BAD HABITS THAT CAN LEAD TO VEHICULAR HOMICIDE. Please try to stop her. Thank God you weren't killed. The next person may not be so lucky.

Well, unfortunately you can't really recover (legally) for anything less than the actual harm that's done to you (which includes physical and only some types of mental/emotional harm). Although there are certain exceptions for things like punitive damages - you'd really need a lawyer to analyze your local laws and tell you if they apply. You'd most likely have to actually file suit to get them though.

You might want to see if she's been criminally charged in this incident and call the local prosecutors office. Most states have a crime called "culpable negligence" - which'd seem to encompass rear ending someone if you were doing something stupid.

Unfortunately, as a criminal defense attorney, I can tell you that criminal prosecution does not often change anyones ways (at least those set in their ways). Prosecution will sometimes lead to people just driving with no insurance because the country isn't set up to be friendly to the car-less. The one exception seems to be the "good scare" scenario, where someone young or a first time offender is given a good enough scare that they do change what they do. Actually following through on the threat though can often be counter productive - at least as far as deterring a specific individual from doing the same thing again. I don't know if this applies to your rear-end-er or not.

One way or the other - my non-legal advice is to get a full diagnostic check up, make sure there are no lingering injuries, and make them pay you for each and every bruise. Even if that very last bruise is only an additional $5.

It's getting so much more dangerous with all the "distractions" any more, and the laws and enforcement is so far behind the curve of the growth of these electronic addictions, it will probably be years before and if anything actually changes. It's hard not to get really angry, to the point of wanting to beat some sense into someone when they blindly drive while texting or talking on the cell phone and nearly run me over. I'm constantly on the lookout for these idiots and that's the only way I've avoided being run over by them, several times. I've had to pull over and sit a while to get my mind back to a good mode to ride in after nearly having someone hit me with a cell phone up to their face, hiding their vision on my side and taking their mind off of what is most important. And many of them act like it is your fault for being there.
I'm thankful you weren't injured too badly, and so sorry for your bike. If they would make serious examples out of those who cause accidents because of their negligence, maybe it would get some attention, but in this country, I doubt it will ever happen. Public hanging is long gone...

glad you are ok. its not a fun expierence i have had the wrong side of the bike on the ground a couple of times. rear ended once in a chain reaction if it hadnt been for the crown vic behind me the honda would have hit me at about 35 -40 she never even saw the redlight or the cars and me stopped at it. i tell my wife all the time motorcycles are totally safe people in cages like her are dangerous. i get on to her for texting and driving all the time and she wonders why i wont answer my phone. stay safe and keep the shiny side up

The bike can be fixed or replaced, you on the other hand are more complicated. Real happy to hear it's the easier of the 2 fixes. Glad you're OK rider bro.

I too have felt the above mentioned emotions and plotted on how best to seek my revenge and also to train the idiots. I almost feel that its not really wrong because that cager had become a danger and posed iminent life threatening harm by their stupidity. Just because its stupidity or ignorance ..doesn't mean its not attempted manslaugher or other crime. After witnessing the complete stupidity of people in their briefcase, typing, putting makeup on, and the cell to the side of face....I now trully understand why some bikers would go off and kick the cagers behind, throw marbles, and any manner of evil. I am not sure how else the cager would understand the seriousness of their behavior. I think that if I wasn't already a federal officer ..I would possibly have choked a person or two. I understand that I must have "no mind" but its like you said...an effort. You have to pull over and do something that takes your mind off of that aggression....Fight or Flight response....
